Terms & Conditions (Advertiser Agreement)

By creating an account, submitting an advertisement, funding a campaign, or using any service on
KMULTIMEDIA Africa (“KMULTIMEDIA”, “we”, “us”), you (“User”, “Advertiser”) agree to be bound by these Terms.
If you do not agree, do not create an account or submit an ad.
1. Definitions
- Screens: Digital LED displays managed by or partnered with KMULTIMEDIA.
- Ad / Creative: Image or video content submitted for display.
- Wallet: Stored advertiser balance used to fund campaigns.
- Proof-of-Play (PoP): Playback events logged by screen devices.
2. Eligibility & Account
- You must be at least 18 years old and capable of entering a contract.
- You must provide accurate information and keep your account secure.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Ad Submission & Approval
- All ads are subject to review and approval (manual and/or automated).
- We may reject or request edits for content that is illegal, misleading, explicit, hateful, or unsafe, or that may harm screen owners/public.
- Approval is not guaranteed and is at KMULTIMEDIA’s discretion to protect the network.
4. Delivery & Scheduling
- Delivery depends on screen availability, orientation compatibility, selected timeslots, package priority, and budget.
- Delivery quantities and timelines are estimates, not guarantees.
- Campaigns may be paused due to insufficient funds, downtime, compliance review, or administrative action.
5. Proof-of-Play & Reporting
- PoP is generated from screen device logs and may appear in batches rather than real time.
- Temporary discrepancies may occur due to connectivity, restarts, or maintenance.
- PoP is best-effort verification and not a legal guarantee of exposure.
6. Payments, Wallet & Billing
- Campaigns require sufficient funds reserved in advance.
- Payments may be made via Wallet top-ups and/or Paystack where available.
- Wallet funds are non-transferable, non-interest-bearing, and may be consumed as delivery occurs.
- We do not store card details; payment processing is handled by third-party providers.
7. Refunds & Cancellations
- Wallet top-ups are generally non-refundable once credited.
- Unused campaign balances may remain in your Wallet for future campaigns.
- No refunds for already delivered/served ads, advertiser-paused delivery, or downtime beyond reasonable control.
8. Downtime & Availability
- Screens may go offline due to power, hardware faults, network issues, or environmental conditions.
- We are not liable for temporary unavailability. Where possible, delivery resumes automatically once restored.
9. Advertiser Responsibilities
- You must own or have rights to all submitted content and claims.
- You must ensure your content does not infringe third-party intellectual property rights.
- You indemnify KMULTIMEDIA for claims arising from your submitted content.
10. Admin Overrides & Enforcement
- KMULTIMEDIA may pause, remove, or refuse ads that violate these Terms, are suspected fraudulent, or are required to be removed by law or screen-owner policy.
- We may request additional verification for suspicious accounts or payments.
- We may preserve logs and records for auditing, disputes, and compliance.
11. Limitation of Liability
- To the fullest extent permitted by law, KMULTIMEDIA is not liable for indirect or consequential losses.
- Our liability is limited to the amount paid for the affected campaign/delivery period where applicable.
12. Privacy & Data Protection
Personal data is handled under our Privacy Policy and in line with the Kenya Data Protection Act, 2019.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after updates constitutes acceptance.
14. Governing Law
This Agreement is governed by the laws of the Republic of Kenya.
